Certification for information and communication equipment is implemented based on Article 33 of the "Telecommunications Basic Act" and Article 46 and 57 of the "Radio Waves Act" For equipment specified in Article 3 of the "Regulation for Certification of Information and Communication Equipment", should be certified and affixed with the required label in order to manufacture, import or sell.

According to Article 48 of the "Telecommunications Basic Act" or Article 84 of the "Radio Waves Act", the Following Penalties can be sentenced for Violation:
A person who manufactures or imports equipment without obtaining Type official approval, Type registration or EMC registration, may be sentenced to imprisonment of less than 3 years or fined up to £Ü 30,000,000.
A person who manufactures, sells, or imports equipments subject to Type approval without certification, may be sentenced to imprisonment of less than 3 years or fined up to £Ü 30,000,000.
